It's not the crossing feature but the enhance tunnels feature.
This allows a lot more construction on limited space...

Nightly versions allows even more construction,
like junctions and with custombridgeheads you get a lot of power in the 
hand.

And about the other topic, there was enough discussion and the copyright 
is still intact,
Chris and Atari made an out of court settlement about RCT too...
